Shariatization of Indonesia: Law Opportunities, Social Limits and Prospects in Contemporary Aceh

Annotation: The purpose of the article is to analyse the problems of Sharia law and the Shariatization of law in modern Indonesian society at the regional level in contexts of the experience of Aceh. The novelty of the study lies in the analysis of the problems of Shariatization of Indonesian society, which are among the least studied in modern Russian historiography. Methodologically, the article is based on the principles proposed in the new social history, which allows us to analyse the phenomenon of Shariatization through the prism of society’s reaction to forced modernization, which stimulated the rise of contradictions between Sharia as part of the traditional political and legal culture and the new norms transplanted into the secular model of development. Thus, the processes of Shariatization of politics and law in Aceh are analysed in contexts of the “traditionalism” / “modernity” dichotomy. The author analyses the contradictions generated in modern Indonesian society by the processes of Shariatization, which emerged as the reaction of traditionalists and the conservative part of the Ummah to the consequences of social, economic and political modernization. The results of the study suggest that 1) the legal parallelism associated with Sharia has the regional nature, 2) in fact, Sharia laws are an important factor for modern Indonesian society, 3) the academic community of the Ummah is actively studying Sharia laws, stimulating the interest of Indonesian society in Shariatization in general. Thus, it is assumed that interest in the problems of Sharia and Shariatization in modern Indonesian society is cyclical and opportunistic in its nature, depending on the modernization policy of the ruling elites in general, and on the solution of specific problems within the the current political process and electoral cycles in particular.
