The Philippines against China in the Haig tribunal

Annotation: The article examines the problem of territorial disputes in the South-China Sea, particularly the Philippine’s lawsuit against China in the Arbitrational Tribunal in the Haig of 22 January 2013. The author stresses that the lack of the normative status of the South-China Sea leads to endless legal dispute, diplomatic conflicts and dangerous incidents. The debate is on three questions: the delimitation of the exclusive economic zones (EEZ) and continental shelf; sovereignty over the islands; freedom of navigation in the EEZ and in the vicinity of the archipelagos.
