Annotation: China bases its claims on the Paracel and Spratly Islands on the right of discovery and on the fact that in the past they were under Chines jurisdiction. All littoral states refuse to recognize the so-called China’s “historical rights” to the South China Sea. Just and acceptable for all decision could be achieved only by the parties to the dispute themselves in case they act in the spirit of good will and compromise leaning on the tested “ASEAN method”.
